• Postadresse: Eine beliebige Adresse, an welcher die Post entgegengenommen wird. Hierbei kann es sich auch um ein Postfach handeln. Als „offizielle“ Adresse ist eine reine Postadresse nur für Menschen ohne festen Wohnsitz zulässig. Also für Obdachlose – und für digitale Nomaden, die sich in Deutschland abgemeldet haben.
• Ladungsfähige Anschrift: Eine Postanschrift, unter welcher Ihnen auch eine behördliche Vorladung zugestellt werden kann. Dies bedingt natürlich, dass jemand – Sie selbst oder ein Zustellungsbevollmächtigter – die Post persönlich entgegen­nehmen kann.

Die ladungsfähige Anschrift ist Pflicht für alle Unternehmer

Jede Firma muss eine ladungsfähige Anschrift bekannt geben, unter welcher ihr rechtssicher Dokumente zugestellt werden können, zum Beispiel eine Klageschrift, einen Mahnbescheid oder eine gerichtliche Vorladung. Dies geht aus den folgenden Paragraphen hervor:

• 29 HGB (Eintragung ins Handelsregister)
• 8 Abs. 4 Nr. 1 GmbHG
• 253 Abs. 2 Nr. 1 und § 130 Nr. 1 ZPO (Zivilprozessordnung)
• 5 Abs. 1 Nr. 1 TMG (Impressumspflicht im Telemediengesetz)

Was als ladungsfähige Anschrift gilt, geht aus der Rechtssprechungspraxis hervor. Definitiv nicht als ladungsfähige Anschriften gelten reine Postadressen, wie zum Beispiel ein Postfach oder ein gewöhnlicher Postscan-Service. Der Sinn des Impressums: Wenn jemand juristisch gegen den Website-Betreiber – das Unternehmen – vorgehen will, kann er hier nachlesen, an wen er sich wenden muss. Und wenn eine Behörde dem Unternehmen ein offizielles Schreiben zustellen will, erwartet sie, dass das Schreiben unter dieser Anschrift garantiert entgegengenommen wird. Wer keine ladungsfähige Adresse im Impressum angibt, muss mit schwerwiegenden rechtlichen Konsequenzen rechnen[2]:

• Geldbuße wegen Ordnungswidrigkeit, gestützt auf § 5 Abs. 1 TMG und §16 Abs. 3 TMG. Es sind Geldbußen bis zu 50.000 Euro möglich.
• Viel häufiger kommt es jedoch zu einer Abmahnung wegen eines Wettbewerbsverstoßes nach dem UWG (Gesetz gegen den unlauteren Wettbewerb). Der Streitwert liegt meist  im vierstelligen Bereich– eigene Aufwendungen für Anwälte, usw. nicht mit eingerechnet.
